This sales policy regulates the commercial relations between Pit Stop Camper di Leonardo Niccoli (CF. NCCLRD83M26D612A), with registered office in Florence (FI), Via di Scandicci no. 310/A (hereinafter also referred to as the "Seller") and consumers/professionals (hereinafter also referred to as the "Customer") for purchases made through the "https://pitstopcamper.com/it" website  (hereinafter also referred to as the "Website") in accordance with Legislative Decree no. 206/2005 (so-called " Consumer Code"), Legislative Decree no. 70/2003, Directive 2011/83/EU and EU Regulation 2016/679.

1. Recipients

These conditions of sale apply exclusively to so-called purchases. "B2C", i.e. carried out by the "consumer" as qualified pursuant to Article 3 of the Consumer Code ("natural persons acting for purposes unrelated to any entrepreneurial, commercial, artisanal or professional activity carried out").

The provisions contained in this policy - unless expressly excluded - also apply to so-called purchases. "B2B" i.e. carried out by a "professional" as qualified pursuant to Article 3 of the Consumer Code ("natural or legal person acting in the exercise of his entrepreneurial, commercial, artisanal or professional activity, or an intermediary thereof").

2. Subject matter of the Agreement

The products offered on the Website include motorhome accessories and parts. 

In compliance with articles 49 et seq. of the Consumer Code, each product is accompanied by the image of the product itself and the consumer, before confirming the order, is provided with the following information: 

main characteristics of the products;

information on product availability; 

identity of the Seller;

the geographical address where the Seller is established, its telephone number and its e-mail;

geographical address of the Seller to which the Customer can direct any complaints;

total price of the goods, including taxes applicable at the time of the order;

payment methods;

delivery methods, costs and times;

conditions, terms and procedures for exercising the right of withdrawal;

existence of the legal guarantee of conformity of the product;

conditions of after-sales assistance;

possibility of using out-of-court complaint mechanisms.

3. Purchase Procedure

The purchase of products through the Website takes place in the following phases:

Order: the Customer selects the desired products, adds them to the "cart", completes the order by "flagging" the acceptance of the conditions of sale covered by this policy and "clicking" on the button that shows the wording "order with obligation to pay" pursuant to Article 51 of the Consumer Code.

The completion of the order procedure is considered, for all legal purposes, a contractual offer. 

Order Confirmation: the Seller sends the Client an order confirmation via e-mail, containing the details of the purchase (order number, description of the products, prices of the products, shipping and applicable taxes, payment method and method chosen, delivery times, name of the recipient and shipping address, plus a copy in pdf format of the version of this policy in use at the time of purchase). 

Conclusion of the Contract: the contract is considered concluded upon receipt by the Customer of the order confirmation, containing the summary of the contract stipulated  pursuant to Article 51 of the Consumer Code, unless the Seller communicates the impossibility of processing the order.

4. Prices and Payments

Product prices are indicated in euros (€) and include VAT, unless otherwise stated. 

Shipping costs are indicated separately from the product price, visible during the checkout process. 

Payment can be made by:

Credit/debit card; 

Bank transfer (in this case, the order is processed only after the actual credit to the Seller's account);

In any case, payments are handled through secure platforms that comply with security standards. 

5. Shipping and Delivery

The delivery of the products, unless otherwise indicated on the product page, takes place within 30 working days from the conclusion of the contract (order confirmation) pursuant to Article 61 of the Consumer Code. 

Upon shipment, the Customer will receive a tracking code to monitor the delivery. 

The Vendor makes the delivery using the couriers indicated on the web page https://pitstopcamper.com/it/content/31-spedizioni to which reference is made.

All couriers employed are insured to fully cover the cost of the products purchased.

Shipping is guaranteed in Italy and in the EU countries indicated on the web page https://pitstopcamper.com/it/content/29-spedizioni to which reference is made.

Any delays will be promptly communicated to the Customer.

The Seller may not be held responsible under any circumstances for any damage, loss or loss of the product occurring during transport, nor for delays in delivery attributable to the courier in charge or to force majeure, unforeseeable events or events not directly attributable to the Seller, such as, but not limited to: strikes, adverse weather conditions,  customs blockades, natural disasters, measures of the authority or delays attributable to third parties.

6. Right of Withdrawal

Pursuant to art. 52 et seq. of the Consumer Code and EU Directive no. 83/2011, the Customer has the right to withdraw from the contract, without giving reasons, within 14 days of receipt of the product pursuant to art. 67 duodecies of the Consumer Code, or, in the case of multiple goods, from the receipt of the last good.

The right of withdrawal must be exercised by the Client by express communication of the intention to withdraw, with an attached indication of the product purchased, sent to the Seller's e-mail address (info@pitstopcamper.com). 

The product subject to withdrawal must be returned by the Customer to the Vendor at the address in Florence (FI), Via di Scandicci n. 310/A, within 14 days of the notice of withdrawal, intact, in the original packaging and complete with all accessories. 

Return shipping costs are the responsibility of the Customer, unless otherwise stated.

Following the withdrawal exercised by the Client, the Seller shall refund all payments received, including standard shipping costs (excluding any additional costs for express deliveries), within 14 days of receipt of the notice of withdrawal, using the same payment method used by the Client.

Pursuant to art. 59 of the Consumer Code, the Customer's right of withdrawal is excluded for the following products:

products that are not present in the catalogue of the Website and that the Seller has found on the market at the express request of the Client;

products in the catalogue of the Website and which, at the request and according to the Client's specifications, have been customised or "tailor-made" changes made by the Seller or the manufacturer;

sealed products that could lose their characteristics, see their properties altered or their functionality compromised once removed from the package.

The provisions contained in this paragraph (paragraph 6 of this policy) do not apply to purchases made by the Customer who qualifies as a "professional" pursuant to Article 3 of the Consumer Code.

For tax reasons, the return of the product must be made exclusively by post/courier. Returns made directly in the store are not accepted as proof of return is required.

7. Legal Warranties 

All products sold on the Website are covered by the legal warranty for any defect/non-conformity of the products themselves that occur no later than 2 years from delivery pursuant to Article 133 of the Consumer Code.

In the event of a defect/non-conformity of the product, the Customer must:

request the Seller, no later than 2 months from the discovery of the defect/non-conformity (limitation period), to send the appropriate form for the exercise of the right of warranty, by contacting him at the web address info@pitstopcamper.com.

fill in the aforementioned form by reporting the defect/conformity detected and requesting the repair/replacement of the product pursuant to Article 135 bis  of the Consumer Code. In the event that the purchased product bears the indication "article to be installed only by professional subjects", the form must be completed by the installer or references must be provided for any contacts and technical clarifications.

Send the completed form to the Seller at the web address info@pitstopcamper.com at the same time return the product to the Seller at the address in Florence (FI), via di Scandicci 310/A. 

In the event of activation of the legal warranty, the Client has the right to obtain from the Seller, at no cost pursuant to  Article 135 ter of the Consumer Code, the following remedies:

restoration of conformity by repair or replacement, within 120 days of the return of the product;

price reduction or termination of the contract, only if repair or replacement is not possible or is excessively expensive for the Seller.

In any case, the warranty does not apply if the product has been damaged due to negligence or tampering with the Customer.

The provisions contained in this paragraph (paragraph 7 of this policy) do not apply to purchases made by the Customer who can be qualified as a "professional" pursuant to Article 3 of the Consumer Code, to which the provisions of Article 1490 et seq. of the Italian Civil Code apply exclusively.

8. Protection of Personal Data

The Customer's personal data are processed in compliance with EU Regulation 2016/679 and Legislative Decree 196/2003 and subsequent amendments. 

The information on the processing of personal data is available in the Privacy Policy section of the Website. In any case:

all data collected is used exclusively for the execution of the contract, order management, shipping and compliance with legal obligations; 

the Customer has the right of access, rectification, erasure, limitation of processing, data portability and opposition, by contacting the Seller at the e-mail address info@pitstopcamper.com.

9. Complaint Management and Dispute Resolution.

The Customer, in the event of any problem regarding the products purchased on the Website, may send a complaint:

e-mail address info@pitstopcamper.com;

by registered mail with return receipt to the address Firenze (FI), Via di Scandicci n. 310/A.

The purchase of any product through the Website is governed by Italian law and the competent court for any dispute concerning the purchase of products from the Website is that of the Customer's place of residence. 

In any case, the Seller is not responsible for non-compliance due to causes not attributable to it or force majeure (riots, computer failures, strikes, impossibility of supply, etc.)

10. Changes to the Policy

The Seller reserves the right to modify this policy at any time. 

Changes will be communicated by posting on the Website and will take effect for orders subsequent to posting.
